The number of foreign employee
Hi, today I want to write about the compliance about the number of foreign employee in Mexico.
- Generally, your company should have 9 Mexican employees against 1 foreign employee in Mexico according to article 7. of Mexican labour law.
It might be sometimes difficult to follow the rule because there might not be mexican employee in a specific industry in Mexico. However, don’t worry about it too much.
Actually there is exception about this topic.
- For instance, if the foreign employee are working for the company as “Directors, Administrators and General Managers, this article is not applied to these persons. In other words, these worker isn’t counted as foreign employees.
How should we (Foreign companies) deal with and handle this?
Personally, if you utilize the exception on specific worker like Administrator, the job this description of the workers is quite important because it can be the reason for considering the person as exception. In this sense, specific position of their job (Ex, Administrator of 〇〇 department) should be mentioned in the labour contract.
Although this might be considered as the way of taking measures extremely for the law, it is better to do this so that you can explain with the proof to the authority in the case that authority said or check something your company like random audit without the notification of visit.

Artículo 7o.- En toda empresa o establecimiento, el patrón deberá emplear un noventa por ciento de trabajadores mexicanos, por lo menos. En las categorías de técnicos y profesionales, los trabajadores deberán ser mexicanos, salvo que no los haya en una especialidad determinada, en cuyo caso el patrón podrá emplear temporalmente a trabajadores extranjeros, en una proporción que no exceda del diez por ciento de los de la especialidad. El patrón y los trabajadores extranjeros tendrán la obligación solidaria de capacitar a trabajadores mexicanos en la especialidad de que se trate. Los médicos al servicio de las
empresas deberán ser mexicanos. No es aplicable lo dispuesto en este artículo a los directores, administradores y gerentes generales.
